Yinfei Wu has significant experience in trademark, copyright, and advertising law in both the United States and China. She advises clients and works closely with counsel around the world on trademark usage, counseling, clearance, prosecution, domestic and worldwide portfolio management, oppositions, cancellations, invalidations, litigation, and enforcement matters.

Yinfei offers trademark and anti-counterfeiting counseling to various Fortune 500 companies. She conducts searches and manages global trademark prosecution and enforcement matters for many publicly traded companies. Yinfei also handles opposition, cancellation, expungement, and reexamination proceedings before the Trademark Trial and Appeal Board (TTAB) of the U.S. Patent and Trademark Office (USPTO), litigation in district courts, and investigations before the U.S. International Trade Commission (ITC). She has been ranked regionally for her contributions to the fields of prosecution and strategy by the World Trademark Review (WTR).

 

Yinfei’s practice related to China focuses on enforcing clients’ rights against counterfeiters and managing civil and criminal anti-counterfeiting actions. Through a clerkship with the City Attorney’s Office of Nanjing, China, she assisted in prosecuting counterfeit product manufacturing and false designation of source of goods claims. Notably, Yinfei clerked and managed trademark litigation at two High Courts on the provincial level and the Supreme Court of China.

 

Yinfei offers experienced legal analysis and has worked on solutions for infringement risk-management matters. Her legal education and cultural background further allow for effective communication between clients and opposing parties during licensing negotiations, settlement conversations, and litigation.

 

Yinfei devotes time to pro bono matters, including working with the Advocates for Human Rights and for the Mille Lacs Homeless Connect.

In the Matter of Certain Semiconductor Devices and Products Containing the Same

Achieved a comprehensive victory for respondent Innoscience, a global leader in gallium nitride (GaN) power devices, in a high-profile patent dispute before the U.S. International Trade Commission (ITC). The ITC’s Final Determination confirms that Innoscience avoided all patent claims asserted by Infineon.

In the U.S. District Court for the Southern District of New York, Finnegan successfully defended a lace designing and textile manufacturing client over a motion to dismiss against unauthorized use of its laces in front of U.S. District Judge Ronnie Abrams. In that suit, Judge Abrams allowed Finnegan’s client to continue to pursue its willful copyright infringement claims against an international franchise in the apparel industry.

Obtained preliminary and permanent injunctive relief and damages in high-profile infringement in China. The Supreme People’s Court, the highest court in China, affirmed the decision, securing a complete win for Under Armour.
